LICENSES REQUIRED FOR HOSPITAL

It is a mandatory registration required for each director who wants to be a part of a company.
It is a onetime registration for each director. It is not required for individual proprietors and for partnership firms.
2 Private ltd company registration / Partnership firm registration / Proprietorship

It depends on the corporate structure of the proposed entity.
The firm can be registered as a private ltd company or a partnership firm if there are multiple partners/owners or as a proprietorship firm or single limited liability company in case of a single owner.
Companies come under Ministry of Corporate Affairs while proprietorship and partnership firms do not require registration under the same.
3 Registration under societies registration act, 2001 Local state auth In case the hospital is being established under the ownership of society, the society registration act is required.
4 Rental Lease agreement registration

This is mandatorily required if the building is leased.
It is preferable to have the lease taken for a long period (minimum of 8 years lease agreement is generally asked by the banks for issuing a loan).
5 Plan approval and Occupancy certificate of the building

Under purview of Local Muncipal Corporation / state auth

The building be it own or leased should have an approved Building plan and an occupancy certificate before the center starts its operations.
Occupancy certificate is issued after completion of the construction. It is issued if there are no deviations from the approved plan.
Penalty is issued for minor deviations and OC is rejected in case of major deviations.
6 Approval for High Tension Transformer for electricity

Dept of Electricity, State Govt and CEIG (Chief Electrical Inspector to Government) who approve the transformer and panel board design.

Most hospitals require a transformer size of a minimum of 165 KV and High Tension wires.
Healthcare setups have a high consumption of electricity due to the use of medical equipment and HVAC system.
7 Fire Department NOC

State Disaster Response and Fire services department

Fire dept NOC is mandatory before the center starts operations.
To get this clearance, the building should be constructed as per approved plans and should have fire detector and water sprinkler systems along with a separate fire exit.
Fire NOC is required only for hospital buildings which have an height of more than 15 mtrs.
8 Building occupancy certificate

The certificate implies that the building is fit to be occupied by people. Building cannot be used for hospital or for any other purpose unless occupancy certificate is obtained.
Hospital building must be built as per National building code (NBC). This is a comprehensive building standards, issued by Bureau of Indian Standards, that is used for regulating construction of buildings across India. The above licenses and permits largely depends upon whether or not the building is as per NBC.
9 Pollution Control board CFE/CFO (Consent For Operation)

State Pollution control board under the State Ministry of Environment.

10 Bio medical waste authorization from PCB

State Pollution control board under the State Ministry of Environment.

A tie-up with a CBWTF (Common Biomedical Waste Treatment Facility Operator) is required to obtain this authorization .
Each area has a designated CBWTF who are authorized by the government to handle bio medical waste.
11 Udyog Aadhar for MSME registration

Ministry OF micro, Small and medium enterprises, Govt of India

Udyog Aadhar registration is required for health setups coming under the MSME scope
For it to be eligible under MSME , the budget of the center should be less than 1 crore for micro, < 2 crores for small and < 5 crores for medium.
12 Trade License registration

Municipal Corporation

In some state matter is under subjudice .
This is not a mandatory act and is required only if the company wants to trademark its logo or name.
13 Pharmacy registration for medical shop

Office of the Drug Controller

There are different licences for medical shops attached to hospitals (IP) and stand alone medical shops.
There are a few minimum requirements for the registration like the minimum size of the shop ( 250 – 300 sft) and requirements of Air conditioner and Refridgerator .
The license is valid for a period of 5 years.
14 Drugs-Bulk license

15 License for storing and usage of Narcotic Drugs and Psychotropic Substances (NDPS) Office of the Drug Controller The hospitals that uses NDPS for patient care, must obtain license under NDPS act, 1985 from Food and Drug Administration of the state. The license specifies the quantity and type of NDPS allowed and need to be renewed from time to time.
16 license for operating a kitchen Food Safety and Standards Authority of India under the Ministry of Health and Family welfare, Govt of India. The license is required if the health centre runs an in house kitchen for the patients and attendants.
17 Canteen/ F & B license Food Safety and Standards Authority of India under the Ministry of Health and Family welfare, Govt of India.
18 Provident Fund and ESI act Ministry of labour, state Govt It’s a mandatory license for the welfare of the employees.
19 Income Tax PAN and Professional Tax registration Income Tax Department, Govt of India. IT PAN no is mandatorily required for the centre to file its annual returns and pay the required tax.
Professional Tax registration is also a mandatory requirement and allows the centre to deduct tax from source (TDS) or GST from its employees.
20 Radiation Protection certificate BARC and Atomic Energy regulatory body (AERB) They are required for running a radiology and nuclear medicine dept.
The license is valid for a period of 2 years

License to procure Radioactive Material (Diagnostic/Therapy)
AERB BRAC If the hospital uses radioactive substances such as Iodine-125, Fluorine-18 etc., for treatment, it will need a license from AERB to procure and store the same. The license is given for specific radioactive substances for a specific quantity and license must be renewed periodically.

29 Water Local municipal auth The water requirement for the various hospitals would be different from project to project based on whether the hospital is a primary, specialized hospital, etc.
30 Electrical installation certificate chief electrical office of the district This certificate is required as a compliance to Indian electrical rules, 1956 and electricity act, 2014. The certificate is given after satisfactory inspection of electrical installation and sub-station, by the chief electrical office of the district. This certificate is required one time initially.
30 License for operating lift Labour dept If the hospital’s building has lifts installed in it, a certificate must be obtained for operating the same. The certificate is issued after inspection by Lift safety inspector, who assess if the requirements stated under Lifts and Escalator acts act has been fulfilled. The license generally is given for one year and must be renewed annually.
32 Sewage disposal Local municipal auth Well planned sanitary measures for disposal of waste as well as drainage system which includes tanks, pipelines, etc. and permission from the local authorities should be obtained
33 Permit to store LPG cylinder Controller of Explosives under the Petroleum act, 1934 If the hospital store has an LPG cylinder in large quantity for usage in the hospital's Kitchen or hospital purposes, the hospital must have a permit

35 License for possession and use of Rectified / denatured spirit Local excise dept To store spirit beyond a certain quantity, the hospital is required to obtain a permit from state excise department. This is done to ensure that the facility is safe for storing spirit, which is combustible in nature and also that it is not sold illicitly as liquor.
36 Permit for storing Diesel Controller of explosives If the hospital stores large quantity of petroleum product such as Diesel for using in Diesel generator a permit must be obtained from Controller of explosives, under Petroleum act 1934. The permit is required generally if the storage required is in excess of 30 litres. The rules given under the act must be complied with and the permit must be renewed from time to time.
37 Arms licenses under arms act 1959 If arms are possessed by the hospital or its employees (for example by security guards), a license for the same should be available
38 Approval certificate of radiation emitting equipment BARC Each radiation emitting equipment that are installed in the hospital must have a type approval certificate from AERB. This is for prevention of excessive scattered radiation which can be hazardous to people.
39 Certificate for using Boilers under the Indian Boilers act, 1923 Boiler inspectors of the district If the hospital uses large Boilers, a certificate for its use must be obtained under Indian Boiler’s act from Boiler inspectors. The certificate is generally issued for a period of 3 years and must be renewed in a timely manner.
40 Ambulance vehicle registration RTO The ambulances that are used in hospital must be registered as Ambulance with the road transport department.
Benefits such as exemption of vehicle tax are provided for ambulances
41 Qualification certificates of doctors National Medical Council ( Previously MCI ) The doctors who practice in the hospital must have necessary qualification certificates as per Indian Medical Degree act.
42 Registration of doctors National Medical Council ( Previously MCI ) The doctors practicing in hospital must be registered with medical council of India, in Indian Medical Register.
43 Qualification certificates of nurses State Nursing council The nurses working in the hospital must possess necessary qualification certificate as per the Indian Nursing Council act.
44 Qualification and registration of Dentists State Dental council The dentists working in the hospital must be qualified as per the Dentists act, 1948 and registered under the Dental Council
45 Qualification and licenses of clinical psychologist Rehabilitation Council of India (RCI). The clinical psychologists qualification is regulated by Rehabilitation Council of India (RCI). To practice clinical psychology a license is required from RCI
46 Qualification certificates of therapists AICTE / Other body Some states have specific councils that regulates the professional practices of therapists such as Physiotherapists, Occupational Therapists. For example, Delhi has The Delhi Council for Physiotherapy and Occupational Therapy, Maharashtra has state council for physio and occupational therapy. The hospital must check if their state has relevant councils and regulations for therapists and accordingly ascertain that they possess necessary qualification certificates and registration.
47 Technicians qualification certificate AICTE Various technicians in hospitals such as Lab technician, OT technician, radiology technician, physicists etc. must possess necessary qualification certificate as per AICTE rules for technician, 1987
48 Registration for EPF EPF This one time registration is required for hospitals to eomply with Employee Provident Fund Requirements.
49 License for provision of Psychiatric services District health auth Hospitals providing certain type of services such as de-addiction, treatment of psychiatric disorders, child/adolescent psychiatric clinic etc. are required to register with their state government. The Mental Health act of India becomes applicable on them.
50 Registration for transplantation of human organ Appropriate authority under Transplantation of Human Organs Act, 1994. If the hospital conducts human organ transplantation or organ harvesting, it shall be registered by the appropriate authority under Transplantation of Human Organs Act, 1994. The registration is given on the basis of availability of infrastructure required for conduction of transplant.
51 License for operating blood bank Drug Standard Control Organization if the hospital has a blood bank, it shall comply to the space, manpower and equipment requirements specified under Drugs and Cosmetics act. A license to operate blood bank must be obtained from Drug Standard Control Organization.
This is not required if there is no attached blood bank in the hospital.
The validity is for 5 years
52 Registration under MTP act Local District health authority If the hospital performs ‘Medical Termination of Pregnancy’, they must be registered with their respective state under the MTP act, 1971. Only after registration the place will be approved for carrying out MTP. The approval for MTP is given under 2 categories, category A (without operation theatre facility) and category B (with operation theatre facility). The rules under MTP act, 1971 must be adhered to for carrying out MTP.
